General Terms and Conditions of Sale

These terms and conditions of sale are concluded, on the one hand, by DGJAUTO S.L.U, whose registered office is at Cami les Forques 41, 17600 Figueres, Girona province, Spain, registered under NIF number B55226609 with a share capital of €3,000, hereinafter referred to as Dgjauto s.l.u, and on the other hand, by any natural or legal person wishing to make a purchase via the Dgjauto s.l.u website, hereinafter referred to as “the buyer”.

Purpose

These terms and conditions of sale are intended to define the contractual relationship between Dgjauto s.l.u and the buyer and the conditions applicable to any purchase made through the Dgjauto s.l.u online store, whether the buyer is a professional or a consumer. The purchase of a good or service through this site implies the buyer’s unconditional acceptance of these terms and conditions of sale.

These terms and conditions of sale shall prevail over any other general or special conditions not expressly approved by Dgjauto s.l.u. Dgjauto s.l.u reserves the right to modify its terms and conditions of sale at any time. In such case, the applicable conditions will be those in force on the date of the order by the buyer.

Characteristics of the goods and services offered

The products and services offered are those listed in the catalog published on the Miprixauto website owned by DGJAUTO S.L.U. These products and services are offered subject to availability. Each product is accompanied by a description established by the supplier; packages are opened for photography and a quality check before dispatch. A mark is affixed for identification in the event of a return. As these are clearance items, small components may be missing (screws, clips, keys, etc.); see the contractual photo.

The catalog photographs are contractual and non-contractual; they cannot ensure a perfect similarity with the product offered, particularly with regard to colors.

Prices

The prices shown in the catalog are VAT-inclusive prices in euros, taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of products or services. Dgjauto s.l.u reserves the right to modify its prices at any time, it being understood, however, that the price listed in the catalog at the time of the order will be the only price applicable to the buyer. The prices indicated do not include order processing, transport, and delivery costs, insofar as deliveries take place in the geographical areas set out below.

Geographical area

Online sales of the products and services presented on the site are reserved for buyers residing in France, the French overseas departments and territories, Monaco, the European Union, Canada, and the United States, and for deliveries required within these geographical areas.

Orders

The buyer who wishes to purchase a product or service must:

- complete the identification form on which they will indicate all requested contact details or provide their customer number if they have one;

- complete the online order form by providing all references of the chosen products or services;

- validate the order after checking it;

- make payment under the specified conditions;

- confirm the order and payment. Confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgment of full knowledge thereof, and waiver of the right to rely on their own purchasing conditions or other conditions. All data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will constitute signature and acceptance of the operations carried out. The seller will send confirmation of the recorded order by email.

Withdrawal and returns

Non-professional natural-person buyers have a fourteen-day withdrawal period from delivery of their order to return the product to the seller for exchange or refund. Return shipping costs shall be borne by the buyer. Any item that is incomplete, damaged/installed, or without the original packaging will be refused. Poorly designed parcels likely to be damaged will be refused.
Purchases handed over in person and returned within seven days will be subject to a credit note valid for 2 months.
Returns must be made only via tracked parcels such as Colissimo (no pickup points or other delivery companies). Items of an electronic and electrical nature such as ECU, injection pump, key, etc. cannot be returned due to their single-use nature.
In the case of a warranty request, the installation invoice from the professional will be requested (see warranty section).
Deliberate errors (testing due to resemblance/adaptation despite clear indication in the listing) will not be eligible for return or claim.

Payment terms

The price is due upon ordering.

Payments shall be made by bank transfer or bank card; they will be processed through a secure system using the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can read it during transmission over the network.

The buyer’s account will be debited at the time of ordering for the amount of the products or services sent or downloaded. At the buyer’s request, an invoice will be sent to be printed from their buyer account.

Payments by bank transfer generating additional fees must be borne by the buyer, particularly those coming from Switzerland (€18).

Delivery

Deliveries are made to the address indicated on the order form, which must be within the agreed geographical area. The risks pass to the purchaser from the moment the products leave the premises of Dgjauto S.L.U.

We offer 4 shipping methods: DPD transport, estimated delivery time after drop-off at the agency between 24H and 48H; La Poste, estimated delivery time after drop-off at the agency 48H; Envialia and Correos, estimated delivery time after drop-off at the agency 72H.

Shipping costs include transport, packaging, and order processing fees.

The customer must check the condition of the packaging as well as that of the products upon delivery. The customer must not sign the delivery note without making specific reservations (anomaly, damaged product, etc.).

In the event of damage during transport, a reasoned complaint must be made to the carrier within three days from delivery. Delivery times are given for guidance only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer refunded.

In the event of non-collection of the parcel, return shipping costs are the responsibility of the customer and will be deducted from the amount of the refund. Please contact us to request a refund or reshipment (at the buyer’s expense). If we do not hear from the buyer within 30 days, a credit note will be automatically credited to the buyer’s customer account, valid for 1 year excluding shipping costs. Return shipping costs are the responsibility of the customer and will be deducted from the amount of the refund.

Warranty

All products supplied by the seller benefit from the legal warranty provided for by Articles 1641 et seq. of the Civil Code. In the event of non-conformity of a product sold, it may be returned to the seller, who will take it back, exchange it, or refund it. The warranty applies only if installed by a professional; please attach the installation invoice from the professional. All claims, requests for exchange, or refund must be made by post to the following address: DGJAUTO S.L.U Cami les Forques 41 17600 Figueres Girona Spain, within thirty days of delivery.

Liability

In the process of online sales, the seller is only bound by an obligation of means; its liability cannot be engaged for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, service interruption, or other involuntary problems. Intellectual property All elements of the Dgjauto s.l.u website are and remain the intellectual and exclusive property of Dgjauto s.l.u.

No one is authorized to reproduce, exploit, redistribute, or use, for any purpose whatsoever, even partially, elements of the site whether software, visual, or audio. Any simple or hypertext link is strictly prohibited without the express written consent of Dgjauto s.l.u.

Personal data

In accordance with the French Data Protection Act of January 6, 1978, personal data relating to buyers may be subject to automated processing. Dgjauto reserves the right to collect information about buyers, including by using cookies, and, if it wishes, to transmit the collected information to commercial partners.

Buyers may object to the disclosure of their contact details by notifying Dgjauto s.l.u. Likewise, users have the right to access and rectify data concerning them, in accordance with the law of January 6, 1978. The automated processing of information, including the management of users’ email addresses on the site, was the subject of a declaration to the CNIL on 22/12/2013 registered under number 1730527.

Archiving / Proof

Dgjauto s.l.u will archive order forms and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of Article 1348 of the Civil Code. The computerized records of Dgjauto s.l.u will be considered by the parties as proof of communications, orders, payments, and transactions between the parties.

Dispute resolution

These online terms and conditions of sale are subject to Spanish law. In the event of a dispute, jurisdiction is assigned to the competent courts of Girona, notwithstanding multiple defendants or third-party proceedings.
